Frequently asked questions

POSH compliance refers to the requirements under the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013. The Act aims to prevent sexual harassment at workplaces and establish mechanisms for handling complaints.

The POSH Act applies to covered workplaces in India. Employers must comply with applicable requirements, including establishing complaint mechanisms, communicating workplace policies and conducting awareness programmes.

An Internal Committee is responsible for receiving and inquiring into workplace sexual harassment complaints. Employers with 10 or more employees are generally required to constitute an IC in accordance with the POSH Act.

A POSH consultant assists organisations with policy development, Internal Committee formation, employee awareness programmes, IC training, documentation, compliance reviews and guidance on complaint-handling procedures.

Employers are required to organise workshops and awareness programmes at regular intervals to sensitise employees about the POSH Act and workplace sexual harassment prevention.

An external member must meet the eligibility requirements under the POSH Act, such as being associated with an NGO or association committed to women's causes or being a person familiar with issues relating to sexual harassment.

Non-compliance with specified provisions of the POSH Act can result in a fine of up to ₹50,000. Repeated violations may attract higher penalties and other consequences under the Act.

The Internal Committee must prepare an annual report containing prescribed details and submit it to the employer and District Officer. Employers also have reporting obligations under the Act.

A POSH consultant can provide procedural guidance, training and documentation support while helping the organisation follow applicable legal requirements, confidentiality obligations and principles of natural justice.

The Act covers workplaces of different sizes. Where an Internal Committee is not required because the workplace has fewer than 10 workers, complaints may fall within the jurisdiction of the Local Committee constituted under the Act.
